SB 294: Workplace Know Your Rights Notice

Amongst the various new California employment laws in effect in 2026, under SB 294, California employers are now required to provide an additional “Know Your Rights” notice, which informs employees of certain legal rights pertaining to workers’ compensation, the right to organize, and other rights related to immigration agencies and law enforcement. Employers must provide such notice by February 1, 2026, and annually thereafter, as well as to each newly hired employee. The notice must contain a description of the employees’ rights in the following areas:

  • The right to workers’ compensation benefits, including disability pay and medical care;

  • The right to notice of inspection by immigration agencies;

  • Protection against unfair immigration-related practices against a person exercising protected rights;

  • The right to organize a union or engage in concerted activity in the workplace; and

  • Constitutional rights when interacting with law enforcement at the workplace, including an employee’s right under the Fourth Amendment of the U.S. Constitution to be free from unreasonable searches and seizures and rights under the Fifth Amendment to due process and against self-incrimination.

The notice must be a “stand-alone” notice provided separately from other required notices, and it must be capable of being received within one business day of sending. To help ensure compliance, employers are advised to use the template prepared by the California Department of Industrial Relations.
